Ebay hassels...wonder what you would do

I bid on an item on ebay, and do not want it anymore...this guy says I have to pay him $10 for the advertising fee if I don't buy the product I won the bid on. If I don't pay either, he said hes gunna get his lawyer involved. No credit card or money was given.
Could he actually sue me off of ebay, is this possible? I emailed ebay to see how the situation could be resolved...but havent received a messege back yet....just curious what everyone thinks

Shouldnt have bid on it man, pay him the advertising fee, be a good sport, you wasted his time and his auction the least you could do is give him 10 bucks. What was the item btw, or if not, how much did it end at, and was there any other bids?

That's a scare tactic for sure, but really you wasted his money, he'll prolly file a non paying bidder form and get your account suspended for like 30 days or so.

ok, is that the worst punishment I can possibly get? a suspended account? I bid on these 20inch rims...was going to buy them then sell them again. final price was $355 american for the set of 4.

Well technically a bid on ebay is a legally binding contract so I think you're on the hook for it.

Be happy he's offered you a way out of it for $10 because I'm sure that a lot of people wouldn't and would demand the full price for the item. Just pay the guy the $10 for wasting his time and save the hassle of a whole argument.

I'm sure the person you outbid would still be interestied in the item. Try to send them an email tos ee if they are still interested and he'll have a new buyer.

Technically, by bidding and winning you're in a binding contract. I have no experience in this situation however. Good luck.

well he can report you to safe harbour (ebay's legal service) and they can come after you for the total amount of the auction (355USD+ their fees) because as everybody knows, bidding on ebay is entering a legal binding contract...its like going to barret jackson and bidding on a car and winning then being "ha, I dont really want it no more" and they are gonna charge you way more than 10bucks for being a smart *** thats for sure

if it was me you stiffed on an auction I'd leave you the worst non paying bidder feedback (most sellers will cancel a person's bid with that kinda feedback), report you to ebay as a non-paying bidder, report you to ebay safe harbour...and I would especially go through all this trouble cuz u have a lame *** excuse for not buying them

whats your ebay rating? do you have a star yet?

pay the guy 10bucks and forget about it...you are getting off light here

You don't know the whole story...my parents got in a car crash, and i'm not about to ask them for their credit card...that is why i cant buy them...so dont say I have a lame *** excuse becuase i have a perfectly good one

You could pay using other methods, money order, cheque, western union...

Sorry about your parents, but really its still a binding contract, just give him the 10 bucks that he lost.

Don't jerk sellers around on e-bay. Pay for **** with your own money. If I were the seller, I'd either get you to pay for the damn thing or leave you nasty feedback.

He can sue you for breach of contract, but odds are, what... the item is under $1000 so no one is gonna give a ****. Pay up!!!!

well dude I'm sory to hear that about your parents....

howeevr if you don't have your own credit card or method of paying for stuff off ebay you should not be paying in the first place send the dude a money order for the 10 bucks

Excuse me? I use my moms credit card, and then I pay her back...I don't own a credit card. I'm going to get the other bidder to see if he wants to buy it

Agreed! I use e-bay on a regular basis and I would be pissed off too if someone had done that to me. And it has happened! Either buy the rims or pay the 10 bucks, either way, you are binded to the deal whether he sue's you or not!

See personally I don't have a credit card neither, but when I buy off ebay I get money orders for the item, I've never used a CC on ebay, yet I've made like 30 perfect transactions with people. Not being able to use a CC isn't a good enuf excuse anymore.

you don't own a credit card so you shouldn't be bidding on ebay. period. you don't have a method to be personally responsible to pay for your bids and so therefore you shouldn't be allowed to bid. period. you should be responsible enough to not bid. borrowing mommy's credit card and paying her back doesn't cut it and niether does your excuse.

I used to be like that when I didn't have a CC, but now I don't use ebay that much, so its not of any problem.

With regards to your problem with the bid, I say your best bet is to pay the 10 bucks. Its not worth the hassle, the negative feedback. If you explain to him why you are not able to buy them, but you will pay the advertising fee + money for wasting his time, I don't see why he would have a problem(And if your contacting the person you outbid). On the otherhand, ebays bidding agreements are like contracts, I don't know the extent of what could happen, but a contract is a contract.
