ok so a freind of mine came to me with a problem..
they brought a lady over from the phllipines as a caregiver for their child a while back, the caregiver no longer could keep the job because the child grew and started going to school and the mom got laid off
so she started working in a resturant (illegally), she applied for her papers in june (landed immigrant and open sumthing)
i dunno how long she has been here.
there is cook at the resturant who is "using" her by black mailing her, using her status in our country as leverage, while i realize she is not allowed to work as anything other than a caregiver, is there anything my friend can do to help her?
i'm not too familiar on immigration cause i was born here, so any help is appreciated

it takes a LOT of $$ to get the paper work done properly.. you need to hire immigration lawyers, etc.. even then it still takes about a year.
What she can do is find another caregiving job, at least that should buy her some time.. and tell the cook to go jump a cliff..
that or for refugee status, but then she would have to in danger or something..
oh wait..another thing.. you can marry her...city hall style.. automatic citizen!

she is just a permanent resident (landed).
she will still have to write a citzenship test.
as for the initial question.
if a person was brought over to this country as a caregiver for a child but now that child has outgrown they no longer have to maintain being a caregiver. she has the right to do anything she wants.
she should apply for permanent resident. beause she already has the years here to back it up and providing she has no criminal records she can and then she can work somewhere else. Also telling the immigration that she has nobody back home to fall back on helps alot too.

my freind says the gurl cries to his mom all the time, because the cook beats her when the owners arent there, and when she leaves the store. hes using her as leverage saying that if they fire him, he will report her and she'll get deported/ she will loose the application for permenant residence.
i would love to go and kick his ***, loser cant get any so he has to black mail her

As Younes Si said.....contact an immigration lawyer..thats the best way. And she wont have to pay big cash to get this service. There are government sponsored legal services available locally.

it will cost no more than $2000 my wife's cousin came over from italy and payed a lawyer and no has refugee status just make sure that the y know she is in danger if she returns to her home country because she will probably get killed.

thx for your concern everyone,
lets just say the cook "slipped" and bruised his face and broke his leg, and tripped into the dumpster behind the resturant..its quite unfourtunate i guess he was clumsy or sumthing..
