No Way! Car Just Got Smashed!

Wow, a few hours ago (8:30pm) I was down in my room working on an essay when I heard my mom yell my name. I went upstairs and she told me some guy just smashed into my car and took off!

My step-dad was already gone after him and I jumped in my mom's car a minute later. The kid was stopped at the end of my street in shock looking at his Caravan when my step-dad started scaring the crap out of him (I wasn't there at this point). I got there and I guess this is what had happened:

-the kid (17 yrs. old, G1, driving alone, no insurance, taking movies back to the store for his mom) was speeding down my street.

-there was a guy walking down my street and I guess the kid didn't notice until the last minute and tried to swirve out of the way and not hit him.

-he lost control and inexperience led him to keep his foot on the brake pedal while he slid about 100 metres off of the road, through my garbage on the side of the street, across my lawn and into my civic! DAMN!!

The pics of the cars are below. Now here's what's happening now...
The dad of the kid came and said he'll pay for the damage. The ****ty part is... I don't think he can pay b/c he kept telling us "oh you need to negotiate" and "my financial situation isn't too good." F*** that, we aren't taking any "negotiation" crap. But I do feel somewhat bad for the kid b/c he's scared to death and I know how it feels to make mistakes. So we're taking to a shop tomorrow to find out the cost and if worse comes to worse, we can take other measures.

BUT, I don't have collision insurance, and my broker said (before i found out i didn't have collision) that they would take care of everything if I was covered by collision. He also said that the kid's dad's insurance co. won't pay b/c the kid isn't insured! Now I'm thinking I might be screwed if they can't pay for it! I could report the accident, but that will only get the kid charged, right? So I'm thinking my only ammunition now is if I can scare them enough to pay me the money to get it fixed. Are there any other options? I'm not sure, I'll have to figure of this out tomorrow and see what my broker has to say (he's kinda close w/ my dad so I'm hoping something can be worked out).

Any comments on what my options are? Any experience here? Thanks.

Oh man. Thats a real bummer. I just got my front end backed in to by my neighbour who forgot I was in his driveway. No where near as bad as that but it still sucks.

damn.....the dads insurance should pay for that. your car wasnt even moving, so it cannot be a collision claim on your part.

i would report the accident or call the cops. call you insurance as well for advice. they HAVE to either pay or go through insurance. last option is small claims court.

Anyone know the time period within which you need to report a collision to the reporting office?

Edit: this is all I've found so far; I'm in London, Ontario

"When should a driver attend the Police Reporting Centre?

A driver involved in a property damage collision will report the collision at the Police Reporting Centre during business hours, with the following exceptions;"

What a dumbass kid. That looks like it will cost A LOT to fix.

If I was in this situation I would: Call the police and report it RIGHT NOW, call your insurance company and tell them what happened...and do it because you dont want that biting you in the *** if you have to go to court .."well we decided to negotiate since he didnt have a licence, or insurance.." judge judy would flip on you lol.

already by your story i can tell that kids dad is trying figure out a way to screw you over...call the cops, if the kid gets charged (and he will) it serves him right for being a dip ****, and he was obviously driving too fast to slide that far...cops! call now!

Alright, since the reporting stations hours are until 11pm, and it says to report it during business hours, I will see what the cost of the damage is first thing in the morning and then if the guy can't give me a certified cheque at that moment, I'm going to report it first thing. Thanks for the input.

I called my insurace co and they said that the dad's company will try to avoid paying (and I'm not sure; may may not even be obligated to pay). Not sure though, b/c his mom gave him permission to drive the car, so that might be different from if he took it w/o anyone knowing. Also not sure about it being a collision claim, maybe my broker just said that b/c it was like 10:00 and we called him at home. Not sure, but I will find out more tomorrow morning.

Call his dad up and get the straight goods.. looks like they have enough money to drive a nice van then they can afford to fix your car..

Ps. Dont paint your drums blue.

And why not still call the cops.. hes in the wrong not you!

That's true. Don't feel bad for the kid he hit your car and ran. Take his *** to court if you have too.

The kid violated four things:

- hit and run
- G1 license without a G licensed driver accompanying him
- speeding
- no insurance

Your insurance company should still pay for your damages. Collision is only if you are in an accident and you are at-fault then the insurance company will pay to have your car fixed. Without collision and you are in at-fault accident then your car isn't covered.

But you are not at-fault so the insurance company should pay for it.

if you take it to a honda dealer.
consider your car written off unless they need the business and are willing to replace with used doors etc....

yeah, go legit way for sure........forget the kid. he'll have to suffer the consequences of his actions. imagine he didn't swerve and hit that guy on the road instead. that's a lot worse than hitting your car.

some people are just stupid. his parents should be blamed too for letting their 17 year old son take the car with a g1. damn...

go throuigh insurance... your company will fix your car and most likely sue the uninsured driver for damages. this will teach him to drive within the rules of the road... also make sure you report it to tyhe collision reporting center. (I hope you got all his info, driver's license and plate of the vehicle driven) this will result in numerous charges being laid on him. most will total a pretty hefty find. 5000 dollars alone for driving without insurance (this is different fromt he failure to surrender insurance slip to a cop charge that is only 75 dollars) also the G1 driving alone thing will most likely result in a suspended license.

It's more like it's the paren't fault for letting him go without a licensed person with him. Damn irresponsible.

Report the accident. The kid isn't the only one that needs to learn a lesson.

if he goes through his insuracne.. he will have to pay his own deductable

not to mention since this happened on private property (his driveway) they will make his premium go up.

You only pay deductable if you were at fault, or even 50/50. If you are zero at fault, you won't be charged a cent.

The only time you would pay deductable is when the guy actually got away and no one could catch him. Then insurance will ask for it. In this case, the kid is caught, so they will pay for everything, including the deductable - somehow.

i had similar damage to mine, costed me over $3 Gs to get it fixed. Insist that they cut out the panel and replace it
