I can't log on to my other account for some reason, so I figured I'd post on my buddies new account..
Maybe someone can enlighten this situation here.
THE STORY:
My younger sister's x bestfriend vandalized her car well over a year ago. She spray painted the side door panel, smashed the bumper in, and dented the door. She also smashed my sister brand new laptop that was purchased for school. After all of this, my sister OBVIOUSLY wanted to get paid for all the damages, so this x bestfriend of hers ended up giving my sister $4000. That's all she had, and they agreed to settle it at that, and for whatever dumb reason, they remained friends.
To make sure things were done legit, they did a money transfer at the bank. The x bestfriend transfered $4000 out of her bank account, directly into my sisters account.
WHERE MY SISTER MADE A MISTAKE:
She initialed the bank transfer receipt, and handed it to the x bestfriend, with intentions to let her keep it as proof of payment, so that she'd feel secure, and not think my sister may try and take her to court later on with claims that she hadn't paid yet.
To make a long story short, four months later, the x bestfriends mom physically assaulted my sister in her University residence. She left my sister with permanant facial scars, on the right side of her face, and strained her neck, she was basically living off Extra-strength Tylenol, or Asprin for 3 months. Before this, the bestfriends family has made many violent death threats towards my sister, mainly over this money.
ANYWAY, now, a year later, this x bestfriend took the bank transfer paper my sister initialed, and wrote "LOANED" over top of my sister signature, and she's now taking my sister to small claims court, and is suing for the money back. She basically is trying to make it seem as if she loaned my sister the money, and didn't owe it to her for the damages.
I got together pictures of the damages, quotes on repairing the car, and statements from people who knew what happened, including myself.
Anything else I should do? I'm just trying to help her out cause' she's a second year Nursing student at Uni, so if she's out $4000 after her court date in two weeks, she's really screwed.

They live in the same University residence, well attempted to at least. They roomed together after the initial "vandalism", stupid, but I guess they "made-up" and settled their differences, didn't last too long. Her mother attempted to move in with them. Her family is very foreign, so moving out to school was considred a sin to them. The University residency threatened to kick my sister out if she didn't resolve the issue, which was to have her mother removed. So my sister approached her mom and told her the situation, then she just went at her. The mother later got arrested, and my sister had to take pictures of the scars/blood later on that night. Ever since then it's been threats for the money back, that was owed to my sister to begin with.

A restraining order is due, yes no? Perhaps a long time ago from the looks of it.
I know you probably don't want to hear this because it involves spending more $$, but retaining counsel is the way to go on this. I can see it now, it will turn into a he said/she said issue. Lawyers are pro with that ish, let them handle that. Also consider, if they get a lawyer and you don't - he will surely talk circles around you guys.

MOst courts, well I know the one in Brampton does, has lawyers that will see and help out with your court case if you don't have or can't afford a lawyer. Call up the courthouse ask some questions, don't explain the case at all as it will just be hearsay, just ask about lawyer services at the courthouse. Can't hurt! But you will definitely need a lawyer.

The girl only has a recipt from the bank. DC_Glory has a bunch of **** that will make her win. The judge is going to laugh at the other girl while DC_Glory sits and vasts in her glory.

Judge judy is a **** lawyer. The only goo lawyer on tv is judge alex.
Judgy judy- Has a temper and is acting when she has that temper. Not a good judge
Judge lynn toler- If you havnt noticed, she is sexist. NEVER EVER has a man won on that show
Judge mathis- Very friendly but then never listens to the whole judgment. Doesnt explain things too well.
Judge joe brown- Hes just ****edup and needs anti depressent pills.
